An Ordinance Amending Sections 711.04 and 711.05 of the Codified Ordinances Regarding Peddler Licenses

Whereas, Chapter 711 of the Codified Ordinances of the Village of Chagrin Falls regulates Peddlers and Canvassers and the Village Law Director has determined that it is necessary to amend certain provisions of Chapter 711 regarding license fees and the term of a license; and

Whereas, the Village Council has determined that it is necessary and appropriate to amend Section 711.04 and 711.05 of the Codified Ordinances of the Village.

Now Therefore, Be It Ordained by the Council of the Village of Chagrin Falls, Cuyahoga County, State of Ohio:

Section 1. Section 711.04 of the Codified Ordinances, in the last paragraph is amended to add the following language at the end of the paragraph to read as follows:

except that in the case of a Peddler who is taking orders for future delivery for a company or person who is located out of Ohio and shipping the goods from outside Ohio to a person or business located in the Village shall not be required to pay a fee to obtain a Peddler’s license.

Section 2. The last sentence of Section 711.05 of the Codified Ordinances is hereby amended to read as follows:

Such license shall be valid for a period not to exceed one (1) year.

Section 3. Existing Section 711.05, in the last sentence is hereby amended, with strikeouts for deletions and underlining for additions to read as follows:

Such license shall be valid for a period not to exceed six (6) months one (1) year.

Section 4. Existing Section 7711.05, in the last paragraph is hereby repealed in its entirety which reads as follows:

Such license shall be valid for a period not to exceed six (6) months.

Section 5. That actions of this Council concerning and relating to the passage of this legislation were adopted in lawful meetings of this Council and that all deliberations of this Council and of any of its committees that resulted in such formal action were in compliance with all legal requirements, including Chapter 114 of the Codified Ordinances of the Village of Chagrin Falls.
