Whereas, Codified Ordinance Section 1503.071 was established as a local building code provision that is not in conflict with the Ohio Revised Code or the Ohio Administrative Code, and provides for monitoring alarm system requirements for fire alarms for commercial buildings, as defined in such ordinance, within the Village; and
Whereas, the Village Administration has recommended that Codified Ordinance Section 1503.071(b) be amended to clarify the intent of Section 1503.071(b) as originally adopted to require that any owner of a commercial building who is required to obtain a building permit shall install and maintain a central station fire alarm system.
Now Therefore, Be It Ordained by the Council of the Village of Chagrin Falls, Cuyahoga County, State of Ohio:
Section 1. Section 1503.071(b) of the Codified Ordinances is hereby amended in its entirety to read as follows:
- (b) Central station monitored fire alarm system requirement/application for a building permit. The owner of any commercial building that is required to apply for a building permit shall install and maintain a central station fire alarm system.
Section 2. Section 1503.071(b) of the Codified Ordinances, the full text of which follows is hereby repealed:
- (b) Central station monitored fire alarm system requirement/application for a building permit. The owner of any commercial building that applies for a building permit shall install and maintain a central station fire alarm system.
Section 3. As amended, Section 1503.071(b) of the Codified Ordinances, with strikeouts for deletions and underlining for additions reads in its entirety as follows:
- (b) Central station monitored fire alarm system requirement/application for a building permit. The owner of any commercial building that
appliesis required to apply for a building permit shall install and maintain a central station fire alarm system.
Section 4. Existing Section 1503.071(b), to the extent inconsistent with the newly enacted provisions herein and any other ordinance in conflict with this Ordinance are hereby repealed, except to the extent such code sections are the subject of an enforcement action and shall be considered effective for the purposes of enforcement for any violations that occur prior to repeal.
Section 5. That actions of this Council concerning and relating to the passage of this legislation were adopted in lawful meetings of this Council and that all deliberations of this Council and of any of its committees that resulted in such formal action were in compliance with all legal requirements, including Chapter 114 of the Codified Ordinances of the Village of Chagrin Falls.
Section 6. That in accordance with Section 113.01 of the Codified Ordinances of the Village of Chagrin Falls, public notice of this Ordinance shall be given by posting a copy thereof for not less than fifteen (15) days on the Village website.
Section 7. This Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public peace, health and safety of the inhabitants of the Village and for the further reason that it is necessary that this Ordinance needs to take immediate effect in order to clarify the intent of the central station fire alarm system requirements, this Ordinance needs to take immediate effect; wherefore, provided it receives the affirmative vote of at least two-thirds (⅔) of all members elected to Council, this Ordinance shall be in full force and effect from and immediately upon its passage and approval by the Mayor, otherwise it shall take effect and be in force after the earliest period allowed by law.
